It was reported that Judge Barak Erez is asking the state to respond to the question of Netanyahu’s incapacity following a petition to that effect.
In the Rabbi’s opinion, is it appropriate to issue a judgment to exclude him from the list of defendants? (I am not asking what the court is likely to rule, but rather whether in principle it is right to exclude him).

Absolutely. Not only appropriate but required. He cannot fulfill his role if he adheres to the conflict of interest agreement he signed.

According to this logic, the legal system can neutralize any move against it: simply file an indictment against the prime minister. If he resigns, great, if not, then sign him off on a conflict of interest and go home.

Years ago, there was a rule in the army that anyone who accepts a commander could not serve under him: if the acceptance was serious enough, the commander was transferred, and if it was minor (or not justified at all) then the soldier was transferred so that the commander would not take revenge on him. A soldier who could not stand the commander found an excellent tool to get rid of him.

When there are procedures, who needs justice or democracy.

True. And according to this ideology, every prime minister is a thief and the country can also be shut down. If there is no basic trust in the legal system, then there is no point in the discussion. And if there is more trust in the judiciary than in them, then there is even less point in the discussion.
