Using Palestinians as human shields
Hello Rabbi. A few weeks ago, an investigation was published in Haaretz (for the sake of discussion, let’s assume that all the details I mention here are indeed true) that during the war, a procedure was created in the IDF infantry battalions called the “Mosquito Procedure.” The meaning of this procedure is that sometimes the IDF captures Palestinians in Gaza in order to use them as a kind of human shield, that is, they are sent to places where there is a concern about explosives/there are terrorists there so that they absorb the fire and not our soldiers. They are not drafted into the army and do not receive pay and in fact they have no basic rights. They are completely dependent on our kindness. Does the rabbi think this is a moral thing and does this have any halachic problem?
In my opinion, no problem, as long as there is no other way to handle the matter without victims. See my article on a defensive wall.
What is the difference between this and the "neighborly procedure" that was banned by the High Court?
Who said there was a difference? A ceramic Agbra?!
Just to clarify that this is prohibited by law and indictments have already been filed in the past against soldiers who carried out this procedure.
