Manslaughter

שו”תCategory: HalachaManslaughter
asked 5 years ago

Hello Rabbi,
Is a man who has AIDS and sleeps with a healthy woman, knowing for certain that she will contract and die from the disease, but his entire intention is for the pleasure of lying down and he has no interest in her death at all, is such an act considered murder? Or maybe manslaughter? Intentional? Or accidental?
Best regards,

It doesn’t matter at all what he is interested in or what his goal is. He is a pursuer, and by law a small or foolish pursuer is also a pursuer.
Of course, there is no permission here to kill him because it is after the fact. Just to clarify.

I mean after the fact how he should be judged from a halakhic and moral/legal perspective.

If he knew the act was dangerous, he is a premeditated murderer. The intention doesn't matter here. Of course, it's not really murder, since there is no certainty here, only a risk. But it's not accidental.
