Claim for isolation

שו”תCategory: HalachaClaim for isolation

What does the rabbi think about Rabbi Yaakov Ariel’s ruling that states that a teacher who was not vaccinated and placed students in isolation should be held accountable?

Compensation from the law of retribution and sorrow?

There is definitely a place for this, although not really necessary (Grama’s questions, facing a person destined for the world).

What is the teacher's fault that the state puts them under house arrest for no wrongdoing on their part, like the last of the dictatorships. According to all studies, Corona is much less dangerous to children than the flu. Let them sue whoever puts them there.

His ruling causes much more grief.
Moreover, it is a ruling that was made maliciously, with the aim of causing grief and knowingly.

In contrast to the vile ruling, the teacher who infected was simply infected by someone else unknowingly and infected unknowingly. And for this, the decision-makers and public leaders in the country are responsible.

Throughout life, all kinds of pathogens enter and exit people's bodies endlessly. To this end, the Creator (or billions of years of evolution, whichever you prefer) endowed humans with an immune system designed to attack and cleanse them. Sars-Cov-2 is one of the viruses that a normal immune system is built to successfully deal with. What is the evidence? Despite a high infection rate, there is no epidemic (no excess mortality).

As long as the existence of a pathogen that a normal immune system is not built to deal with is not proven – a person who behaves in a normal human way such as speaking, giving lessons, walking down the street or sitting at a concert – cannot be held responsible for infecting others. This is the normal situation. A person should not check themselves at all times to see if they have some virus that the other person's immune system is unable to deal with.

If someone knows that their immune system is not in good health – He must take measures designed to strengthen (good levels of vitamin D in the blood, exercise, proper nutrition, etc.), or in more serious cases - actions designed to reduce the chances of infection, such as hydroxychloroquine once a week or quinine as a prevention, or even some level of time-limited social distancing (if at all, since a poor mental state that may result from such distancing drastically weakens the immune system according to studies and vice versa) - and not impose restrictions on those who behave in a normal human manner.

Ultimately, this is even more beneficial for those with weakened immune systems, since without coercive mechanisms designed to suppress healthy social activity, a faster immune balance is achieved in the population, less chance of mutations, and the length of time during which they are exposed to infection is reduced.
