Refusal of a divorce from a murderer (who failed to commit murder)

שו”תCategory: HalachaRefusal of a divorce from a murderer (who failed to commit murder)
asked 5 years ago

Today I saw an article that Aviad Moshe is now refusing to give Shira Isakov a divorce (after already trying quite a few bureaucratic tricks, such as preventing their son from receiving medical treatment).
What is the Rabbi’s opinion on the matter? How should the court handle this?

And how does this fit in with the rabbi's positions on the separation of religion and state? In your opinion, the state should not be interested in what the halakha says or what the position of this or that religion is regarding marriage and divorce (just as in a Western country with a Catholic majority, the authorities and courts allow divorce and remarriage without even caring about what the Vatican's position is regarding divorce). It seems in several places that this is the rabbi's position, and you also said this explicitly.
