Halacha buyers.
Peace and blessings.
Sages learn from verses.
What is the content of the study?
Kenin is a consensual legal procedure, there are no rules regarding the application of legal essences, so why does the Torah direct this process?
Why is there special ownership of land, a slave, a wife? It's not a mitzvah, so what is?
In short, I have conceptual ambiguity regarding everything related to kenayim in halakhah. I would be happy if the rabbi could clarify the matter for me.
Thank you and have a nice day.
Most property laws are not learned from verses but from interpretation. But what we learn from a verse teaches us something about the legal facts concerning property. Clearly, if the whole point was to regulate the legal world, the form of regulation would be of no importance, and this is true not only for property laws (but also for the laws of the Shomerim, for example). Apparently the Torah has an interest in certain forms affecting property, and this is not intended only to regulate the legal matter. This is a religious-metaphysical matter. Is there a concept of intellectual property in halakha? Like copyrights. After all, I didn't break into my friend's house and steal something physical from him
