Divorced woman to become a priest in the expropriation of kiddushin

שו”תCategory: HalachaDivorced woman to become a priest in the expropriation of kiddushin

There was a case involving a priest who came to marry a legally divorced woman, and they came before the court. The court revoked the consecration (because it was discovered that he had tendencies, etc.) and thus permitted the priest to marry, because if there is no consecration here, there is no divorce here, and she is single.
But it was argued on his side that the judge stated in the ruling that he would not allow a man’s wife to be a priest because of this, but since she was already divorced at that time, he relies on the expropriation to allow the priest to be a priest.
And the difficulty with his words is that, of necessity, you are forced to seek a divorce because of the prohibition of a man’s wife returning, and as the judge wrote, as a man’s wife, it would not be permissible?

Excellent question. This article was sent this evening, and I thought I would write about it. In my opinion, it is absurd, although it cannot be denied that it is a common halakhic policy.

If he does not permit a man's wife, how can it be taken seriously? It seems absurd to me. Even a man who is attracted to a certain man's wife and marries a woman, his marriage is not valid because of a mistake? After all, the halacha does not recognize sexual orientation, but only an attraction to nakedness.

The posak also admits that it is not possible to permit a man's wife here. That is, he admits that she was married. If she was married, she would need a get. If she received a get, she is divorced and therefore prohibited from being a priest. There is an internal contradiction here. In any case, she would have been married. Even though there, marriage to a priest is also against the Torah and therefore must be made stricter.
