Identifying the Tefillin Scroll Today

שו”תCategory: HalachaIdentifying the Tefillin Scroll Today

Hello Rabbi. I don’t know if the Rabbi is familiar with the issue or if the Rabbi has already been asked about it, so I will go ahead and hope that I am not confusing the Rabbi. This is not the gist of the question, but rather the question about the power of custom in halakhic rulings.

Some claim that following the rediscovery of the Aftzim arrangement, it became clear that the parchment we use today for tefillin is not kosher and we are not fulfilling our obligation according to the majority of the Rishonim (and also according to the Shulchan Arash). Only according to the Rabbi’s method is our parchment kosher, but some claim that if the Rabbi had known about the Aftzim arrangement (which was not there before him), he would have returned to it (if the Rabbi wishes, an article that expands on the matter) https://www.machonso.org/hamaayan/?gilayon=48&id=1445 ).

We will divide the question into three parts:

A. Does the rabbi know the issue and can perhaps provide a halachic conclusion?

on. On the side that decides that in a halakhic sense the card is invalid and must be replaced with another card, is there any room for trust in the custom that the entire Jewish people follow, even though it has a limited basis? Would the answer change assuming that the Rabbis would repeat it?

third. Even if it is said that the custom is kosher to begin with, would it still be preferable to be stricter like the other Rishonim, or would there be a problem in changing the custom (excluding the goats from the Rishonim, the pride, etc.)?

Thank you very much in advance.

I haven’t heard about this issue. To say anything I have to get into the thick of it, and I don’t have time for that right now. I will only comment from the side that one should discuss all the rules in question (including the Central Library) whether they were stated on the bottom line or on the best way to achieve some result. That is, did they require a specific form of processing or card, or are these requirements intended to achieve some quality, and then perhaps it can also be achieved in another way. But as mentioned, I don’t have time for that now.
