Making use of information obtained fraudulently

שו”תCategory: HalachaMaking use of information obtained fraudulently
asked 2 years ago

Hello Rabbi,
I heard a story about two competing technology companies developing a similar technology product. One of the companies obtained information about its competitor by fraud regarding its plans for the product. The information obtained was only the data rate that the product was supposed to support. The company that obtained the information was surprised by the information because it had planned to support a lower rate, and after obtaining the information, they made efforts to support a higher rate and indeed succeeded. The question of what rate to support depends on the amount of resources the company wants to invest and what is currently available in the market, with the goal usually being to slightly beat what is currently available in the market. Was the company allowed to make any use of the information obtained by fraud?
Best regards,

There is no prohibition in the halakha as such on using information obtained through problematic means. The acquisition itself can, of course, be a prohibition. According to what I argued in my article on copyright, there is a Torah prohibition against stealing information, which is plagiarism. If this is true, then there is also a prohibition against using this information.
