Oath for the purpose of receiving an inheritance

שו”תCategory: HalachaOath for the purpose of receiving an inheritance
asked 9 years ago

Hello Rabbi Michael,
In order to receive my aunt’s estate, I was required to sign a document in which I swear to a number of facts regarding her details and my relationship with her. The document is a kind of legal document in England.
My question is whether I am allowed to sign such a document, or whether I should require a “Declare” form.
Best regards,

If it is possible to receive a declarative text, that is of course preferable. If not, you can sign it.

The signing may have to be done in the presence of a lawyer in Israel, before whom we will have to swear orally.
Even then, if they insist on the oath, will it be possible to sign and swear orally?
Or is it more serious if one swears orally?

This is more serious, and my words still stand. In other words, it is even more worthwhile to try and obtain a written statement. And even if you don't get one, you can swear.
