Owning a group gift

שו”תCategory: HalachaOwning a group gift
asked 2 years ago

Our company received quite a few donations of various kinds during the war, and now, as we approach liberation, a question arises: Who owns the donations? Is each soldier the owner of what he received or is the ‘company’ the owner of the donations? In other words, can a soldier who is discharged/leaving take the equipment we received home or must he leave it in the company for the next soldier who enlists in his place?
Should we try to understand what the donors want (in general or perhaps in each individual donation) – who probably haven’t really thought about this question?
Is it correct to divide between military equipment (which has more room to be seen as belonging to the combatant framework as a whole) and civilian equipment?
PS Thank you very much for all the content on the site.

The obvious division is between military equipment and personal equipment. But I think that even with personal equipment, it is appropriate to leave it to the soldiers who will come in your place. It is supposed to serve them in the army and not at home. This is probably also the implicit intention of the donors (even if they did not think about it explicitly).
