Question about freedom

שו”תCategory: HalachaQuestion about freedom
asked 6 years ago

Hello Rabbi.
My wife and I really want a cheap, belly-up vacation.
This is a place where the majority of people are Gentiles.
Is my wife allowed to stay in the pool/s in a swimsuit?
(In the past we went frequently. Today we have become stronger and are interested in hearing the Rabbi’s opinion on what the halakha says)

It is customary to prohibit mixed bathing. I am not sure whether it is possible to establish an unequivocal halakhic prohibition on this, at least with regard to your wife. At most, it is a matter of stumbling before the blind in the presence of the sighted (especially if they reach forbidden reflections). But from your perspective, it is more problematic, since I assume that she will not be the only woman there. If you are convinced that you will not reach forbidden reflections – I cannot really prohibit this either (see Ritva, end of Kiddushin). Ultimately, you need to decide in light of your own knowledge.

I assumed that the rabbi would point the arrow at me, so I already mentioned in the question that I have past experience (:
As for me, I say this without question that as far as I am concerned, I am with my wife in these places. Only she is with me in thought, speech, and deed. And she is the very desire for this.

As for my wife, I apologize for the ignorance. Is there anyone before me who is blind towards a Gentile?

You said that there are mostly gentiles but also Jews.
Regarding your question, the Gemara 87 explains that there is a blind man before him in relation to gentiles (although I think that there is no prohibition among them in contemplating forbidden things).

So in a place where everyone is gentile, with a high probability and assuming that they do not have a prohibition on contemplation.
Then there is certainly room for permission
(You can still change the destination..)

right

Cheers!

My wife continues to ask what about head coverings throughout the hotel in case there are only Gentiles there?

מיכי replied 6 years ago

Head covering is a Torah law of modesty that does not depend on hindering men from contemplation. Therefore, in public places, one must cover one's head.

Have a nice holiday (:
