Regarding there is no penalty from the law

I know that there are two reasons why there is no punishment from the law: 1- Paracha 2- Perhaps a punishment is not due for a serious act and we are not given any punishment for it, based on what we find. Is there any halachic ruling on this in the poskim and also halachic implications directly for the law? (Z\”a Have you come across a ruling or halachic ruling that concerns this?)

There is a ref. For example, the Rasha of the edition of the Batra B.K. (please? Regarding the opening, one is liable for the mining, not the least of all) wrote that there is no rifkah for a “total of two hundred mena” and therefore there are penalties from the law. Although – in my opinion, there is a rifkah for such a rifkah as well. It is clear that there will be no decision on this question in the books of halakhah. They do not deal with the rules.
