The prosecution of the October 7 terrorists
Hello Rabbi,
I understand that there are all sorts of legal difficulties surrounding the prosecution of the October 7 terrorists because it is difficult to link a specific terrorist to a specific crime he committed. I heard someone on the radio suggest that the mere fact that a person belongs to the Hamas organization and is in the fighting zone on October 7 constitutes implicit consent to the commission of the crimes that were committed and therefore constitutes sufficient grounds for prosecuting him for that. What do you think about that? How does this fit in with the issue of refusing the clearly illegal order? Do you have a better suggestion for dealing with terrorists from a legal perspective?
