The limits and sources of authority
Peace to Rabbi Michael
I carefully read and also listened carefully to your lessons on the subject of formal and substantive authority and on facts versus statements and claims in relation to this.
Can the Rabbi provide me with sources for his opinions, if at all there are and are necessary sources for your opinion?
And is it possible to get a reference to the sources of the conservative opposing opinion, even though I know it and will meet with it, I would be happy to receive its more established sources.
Kind regards, Yigal
Maimonides writes in three places in the Pihamash that there is no halakhic ruling on issues that do not concern the actual. But even in his case, it does not mean that he meant what I said, but simply that it is one of the rules of halakhic law in his opinion. In my opinion, there is no possibility of a halakhic ruling on this. I have no sources and do not need sources. Why should I read, it is understood?! The advantage of conceptual analysis is that it is necessary from within itself and there is no need to resort to sources. You will have to clarify the method of the dissenters with them.
Incidental note
In the three matters about which he wrote in his speech, he ruled with a strong hand!
Indeed. See the article by Haneska in Da'at on this.
