Q&A: Roman Zadorov
Roman Zadorov
Question
Hello. Just out of curiosity. Is the Rabbi at all familiar with the Zadorov case? Does the Rabbi think there is reasonable doubt here, and that he should be acquitted? I’d be interested to hear the Rabbi’s opinion.
Answer
I’m not familiar with the details.
I’ll just comment regarding a question that came up in the last discussion, where the appeal was rejected by a majority of two against one. The question raised was whether, when one of the judges votes to acquit, that itself is an indication of the existence of reasonable doubt. In my humble opinion, one should distinguish between a situation in which the judge truly acquits—that is, he determines that the defendant did not commit the murder—in which case that certainly counts as reasonable doubt, and a situation in which he acquits because of doubt, in which case there is a disagreement over whether the doubt is reasonable or not, and there the majority decides. a0
