Request for public donations for the surrogacy process

שו"תRequest for public donations for the surrogacy process
שאל לפני 3 שנים

In honor of Rabbi Michael Arbraham
I would like to know what the Jewish law says about surrogacy and requesting donations from the public for this purpose.
A) Isn't the act of surrogacy for a lot of money – 300,000 NIS requested from the public – an immoral act of "renting" a womb, and in fact, a type of exploitation? Which could be against Halacha ?
b) I heard that when couples are interested in this, a Jewish surrogate is needed. Can a family that is observant of Torah and mitzvot be trusted to choose a Jewish surrogate? Moreover, it is not the intention of someone who intends to donate to shame the recipient by asking all sorts of questions. (If surrogacy is indeed possible according to Halacha)
C) To donate or not to donate (according to Halacha or morality, alternatively)?
*I was unable to formulate a definitive answer to other questions.
*I sent you a link privately.
*I would love to hear your opinion regarding this type of act.

With great appreciation
Thanks in advance.

A. I don't think there is an immoral act here, as long as the woman who has the womb is aware of the situation, the risks, and the process and agrees to them of her own free will. Every action a person takes is done for a specific interest, and that doesn't mean that he doesn't really want it. A person goes to work because he needs money, so should we prohibit employing people? A person puts himself at risk in extreme sports (and in regular sports too), because he likes risks. Should we prohibit him from doing so? An adult can make decisions about himself. I don't know the details of the process, but if you check that consent is given willingly, I don't see any moral problem in this. B. Indeed, there are jurists who claim that if the surrogate is a Gentile, the child must undergo conversion. I do not know what the Chief Rabbinate states on the matter and what the legal procedure is in Israel. In my personal opinion, there is no real concern about this, because in my opinion, the owner of the egg is the mother. I expanded on this in column 514. C. The consideration of whether to donate depends on your priorities.
