I’m interested in law, and I’d like to know whether the Rabbi has written articles in this area (without connection to Jewish law) — on judicial activism, on the relationship between law and culture and which shapes which, legal formalism, and so on.
I’d also be happy for references from the Rabbi to people he has read and whose opinions he respects.
Answer
I’ve written quite a few things on the first and third topics, but usually within other discussions. My book The Spirit of Law deals with the question of activism (the relationship between legislation and adjudication) and a bit with formalism on the philosophical level.
