Is there an obligation to live in the Land of Israel nowadays?
If so, does living outside the biblical Land of Israel but within the borders of the State of Israel count? [The Golan Heights? Eilat?]
Answer
The question of whether there is a commandment to live in the Land is subject to dispute (famously, Maimonides does not count it). As I understand it, this has nothing at all to do with time—whether in the past or today.
According to the views that there is a commandment to live in the Land, simply speaking this is a commandment incumbent on the individual and is not connected to sovereignty; therefore, the commandment applies within the borders of the Land of Israel as defined by Jewish law. According to Nachmanides, there is also a commandment to conquer the Land, and that is, simply speaking, a communal obligation.
