I saw a question about how Esau gave the birthright to Jacob, and after all, the birthright is something that never comes into existence. At first I thought this was just a quibble, but then I saw that the Torah discusses this in its commentary on the Rosh (P. Toldot), and even proved from this that by an oath, ownership of something that never comes into existence occurs, and this issue was also discussed in the Responsa Harivash (S. Sh. 28) and in the Ketzvah (S. Ra'ach) and in the Responsa Shoal Ve'mshiv (Talitah, Ch. 2, S. 23). And I don't understand why I was discussing the laws of purchasers based on a story from the Book of Genesis. What do you think?
