Halacha and morality

שו"תHalacha and morality
שאל לפני 6 שנים

peace,
I am currently engaged in a lot of discussion about the relationship between halacha and morality. I read your article in Akademo (from many years ago) regarding Hebrew law, and Rabbi Yaakov Ariel's response, which mainly concerned the relationship between musar and halacha. He ostensibly presented a different system than yours. After reading many of your words about halacha and musar, I wondered how much he really disagrees with you or whether he just wants to emphasize some aspects that you did not address. After all, he accepts the principled division between musar and halacha, meaning that these are separate systems, and he claimed that despite this, they are intertwined with each other to a certain extent. Is this really a disagreement? Do you think that halacha has no influence on morality and vice versa? I would appreciate it if you could point out the point of disagreement, if it exists.
thanks!

In short. He claims that morality is included in halacha (but there are laws that do not concern morality), and perhaps is even identical with it (all laws express a moral principle. This is implied in several places in the writings of his rabbi, the Rabbi). Whereas I claim that there is no connection. Halacha is an independent category: in my opinion, there is no halacha that concerns morality (except for the regulations of the sages that introduce morality into halacha). This is certainly a fundamental and essential disagreement.
