Regarding your article on modern Orthodoxy

שו"תRegarding your article on modern Orthodoxy

Regarding your article on modern Orthodoxy, you bring up the issue of using superlatives and also mention the issue of conversion. In addition, you quote the Rambam (precisely as an opposing position) who says that whoever cannot guard against slander should go to the caves. So I just wanted to highlight (and comment) that the Rambam in particular is very much in favor of a meta-halakhic approach, even to the letter.
In the reply to Peer Hador (Siman 112), Rambam ruled that it is lawful to free a Gentile slave who lived with a Jew, as well as to convert and marry a Jew, even though this violates an explicit law in the Mishnah (Yevamot 24b). Nevertheless, Rambam permitted this to be done from the beginning, and not only retrospectively. The explanation that Rambam gave for this is: "Because of the principle of the returnees, we said that it is better for him to eat gravy than fat itself, and we relied on their saying that when it is time to do it to the Lord, they have violated your Torah." Not only that, but he even writes there that they should be carried out with blessings, that is, not with feelings of guilt or anything similar. I thought this was a significant addition to the principled position you presented, and I wanted to add a strong emphasis on the article itself.

Freeing a slave or a slave girl for a need was already permitted in the Dina Dagma (RA freed a slave to complete the minyan, and see in the first and last chapters). There is nothing special about this ruling in my opinion. There are more far-reaching rulings by many jurists.
