Hello Rabbi Michael,

I wanted to ask you about the husband's entitlement to the fruits of his wife's melog assets. In the modern world, every working woman has a provident fund, a training fund, and a pension fund. Let's assume that a married couple decides to divorce after 10 years of marriage. In addition, let's assume that the wife brought with her to the marriage provident/pension/training funds worth 100,000 NIS as melog assets. Will the husband be entitled to claim all the interest that accrued in these funds during the 10 years of marriage (adjusted for inflation)?

And if the husband does not demand this because he is unaware, is the wife obligated to inform him?

To the best of my judgment, the interest belongs to her. The fruits that were paid to the husband in the joint property are fruits that are extracted during life and are available for ongoing use (like fruits that are picked from a tree, or gathered from a field). But such interest is added to the principal and is available for use only upon redemption of the principal, so in my opinion it is clear that it is entirely hers. —————————————————————————————— Asks: What would be the answer regarding regular savings in a bank on which the woman accrues interest? This refers to savings that have no restriction on their maturity date. —————————————————————————————— Rabbi: There is room for complacency. I think it also explains that this name is hers. The purpose of fruit envy is for the husband to take care of the field, and that does not exist here.
