Things that are prohibited due to danger

שו"תThings that are prohibited due to danger
שאל לפני 8 שנים

Hello Rabbi Michael Avraham.
Can I allow myself not to act according to the laws based on science, (the essence of which is spelled out in the regulation itself) because science today has revealed that it is a mistake? Should I wait for a court to descend from above and allow me to do these things?
It seems ridiculous to me not to touch your eyes/mouth in the morning, not to eat fish with meat for fear of leprosy, etc….

Hello generation. In principle, if there is a rule that is based on a fundamental error (not on a change in circumstances since then), in my opinion, a person can allow himself to do so. The reason for this is that they did not decree it (like a mistake). I must say that this is my personal opinion, most poskim disagree with this. But one must be careful to clarify two things: 1. It is indeed a halakha because of a certain fact. 2. This fact is indeed an error. Sometimes you misinterpret the halakha (attach it to a fact that is not really the basis for the halakha in question). And sometimes you perceive that there is a factual error here and it is not really an error. And in fact, the examples you gave seem ambiguous to me and there is a lot of room for caution with them (this is an example of the warnings I gave above). A. Regarding touching the eyes, this is an evil spirit and not a health hazard. Since I do not understand evil spirits and their meaning, I do not know if this is a mistake at all and I would not simply permit it. B. Regarding fish and meat, several commentators have written that the leprosy of the Torah is a spiritual disease and not one of the diseases known to us medically. It is true that spiritual leprosy has disappeared in our day and what is called leprosy (which is also no longer found) is the known medical disease. Still, there is room for caution in the eyes of the Jewish people, since if it is a question of spiritual leprosy, perhaps leprosy is an expression of a real problem with eating fish and meat, and this problem still exists today (but it is not expressed in leprosy). It is true that the poskim who refer to this as a danger probably understood it as a normal health hazard and not as a prohibition, and if this is so, then there is certainly room for leprosy. In any case, this shows that one must be careful before deciding, and examine the two points I described above.
