I would only note that it is not clear whether this dispute among the medieval authorities (Rishonim) is a dispute about estimating the parties’ intent or about the halakhic definition itself.
On the face of it, if the parties intend something specific, then that is what it will be (assuming that such a division is possible from the standpoint of Jewish law). Only if they have no definite intention does the halakhic default apply.
