Q&A: Guarantor
Guarantor
Question
The Rabbi wrote in the lectures on the chapter of HaOmanin about agency to hire workers, at the end of section 3, that if the understanding of the law of a guarantor is that it is considered as though the woman herself received the maneh, then it is understandable why in the case of both of them we require that the maneh be given to the man effecting the betrothal. And I am unable to understand why, if it is considered that the woman received the maneh, it is then understood why in the case of both of them we require that the maneh be given to the man effecting the betrothal.
Answer
You’ve got me tangled up. It’s hard for me to get into the details of the Talmudic passage right now. If you want, try reading our book on Synthesis in the Talmud, where I discuss the logical structures in this passage at length.
