Q&A: Laws of Funerals and Cemeteries
Laws of Funerals and Cemeteries
Question
Hello, and blessings, honorable Rabbi.
I would be grateful for your help with a few questions touching on Jewish law from a basic framework, and also from the perspective of your general outlook if you would like to share, on topics such as the soul, the spirit, death, and the like.I should note in advance that I am a layman in the area of Torah, so some of my questions may be basic.
- The boundaries of obligation at funerals and cemeteries:
What is the halakhically binding limit in the context of funerals and memorial ceremonies in cemeteries? Where does the obligation of Jewish law end and the addition for the benefit of the public and the family begin?- The sanctity of cemeteries and fallen IDF soldiers:
How was the conception shaped, and what is the Rabbi's view, regarding cemeteries as places of sanctity-impurity? And likewise regarding fallen soldiers—for example, from a Hidabroot site article on the topic – (link to the article) – what does he think about things of this kind?- Old cemeteries:
What is the halakhic attitude toward burial places where people died more than 100 years ago, when most of the tissues and bones have already decomposed? Why does the place continue to be regarded as having metaphysical significance?- Personality, soul, and death:
How does the Rabbi understand the ideas of individual personality—in relation to the soul—in relation to death, in the Jewish and non-Jewish context? What is the law regarding the sanctity of the deceased person's body? And what is the significance of burying the body in the Land of Israel?I assume these are many questions, and I believe you have already dealt with some of these topics in previous posts. I would be glad if you could direct me to them, so as not to trouble you with writing them out again.
Sorry if this is a bit burdensome—may we know sorrow only in its proper time and hear good tidings.
Thank you very much for your time and effort!
Answer
Hello.
It's hard to answer general questions. This isn't the place to write a collection of encyclopedic surveys. You need to ask about concrete details.
1. I didn't understand the question. Are you asking which parts of the ceremony are a halakhic obligation and which are customs? Almost all of it is custom. The obligation is the purification of the body and placing it in the grave. That's it.
2. There is no difference between fallen IDF soldiers and others. The sanctity of a cemetery is a matter of Jewish law, not custom. It is forbidden to make use of any of the elements of burial for other purposes.
3. There is no connection whatsoever to metaphysical meanings. There are laws about preserving burial places. There are permissions to remove bones when the land is very badly needed.
4. These are general questions. I can't answer them.
I hope we will not merit any more sorrow.
