Hello Rabbi,
If the sages' decree not to play on Shabbat "lest he fix a musical instrument" is, as the Rambam explains (Laws of Shabbat 23:4), a concern that a person might tune the instrument (due to a blow with a hammer), what is the ruling regarding instruments that do not require tuning at all, such as a flute? Let's assume that the parts of the flute are assembled before Shabbat (which is usually the case in reality), and therefore there is no constructive concern.

Would it be permissible as the Rema (O.H. 63) said, "In this time, everything is musical, so that we are not skilled in making musical instruments, and it belongs to the sector, lest he repair musical instruments" or as the Tosafot say in Bitzah 30. " But according to them, we are not skilled in making musical instruments and it does not belong to the sector ."
I know that most of the latter today prohibit this, what do you think?

It is customary to interpret that it is not a phallus, meaning that playing is prohibited at all. The reason for the prohibition is lest someone come to repair it. As you mentioned, we discussed this in our time that no one repairs musical instruments or wears signs anymore. This is a question of taste not a rule. Where it no longer belongs at all, there is certainly room for leniency. Where it is rare but still belongs – it is more difficult to leniency. In my opinion, this is the situation with musical instruments and therefore it is not appropriate to leniency.
