Har HaMor

Question

In column 19 dealing with Har HaMor, the Rabbi wrote the following sentence: “It is important to note that in the case of Har HaMor, as far as I know, this is not happening. It seems that they and their leaders probably really do believe in their path and are not merely engaging in self-interested manipulation…” In light of the new revelations regarding Rabbi Tau, does it turn out that in this sect too not everything is so innocent?

Answer

I have no information on the matter, but I don’t see why it makes any difference.

Discussion on Answer

Yehoshua Benjo (2022-11-10)

There are no new revelations at all. There are only very serious accusations. I wish there would be a resolution to this story one way or the other, and that we wouldn’t be left with accusations but with clear knowledge. Unfortunately, I don’t think that will happen. And really, it has nothing to do with the problems that Har HaMor brings with it.

There are authorized bodies to investigate this (to Yehoshua) (2022-11-10)

With God’s help, on the eve of the holy Sabbath, “Shall not the Judge of all the earth do justice,” 5783

To Yehoshua — greetings,

Complainants who claim that someone harmed them can go to the police or file a claim in an authorized rabbinical court, and if the respondent refuses to appear before the rabbinical court, the court will permit them to sue in civil court. Of course, any court—rabbinical or civil—will require the plaintiffs to bring evidence for their claim and will allow the defendant to defend himself and to conduct cross-examination of the prosecution’s witnesses (and vice versa).

And here I ask: why do the complainants need to turn to social media and the press? If there is a real basis for the complaints, there are excellent addresses for clarification—is there really a lack of “judges and officers” in Israel? Why do Rabbi Cherlow and Rabbi Stav need to write posts and articles in the media about the need to investigate the affair? Let them organize a good lawyer who will accompany the complainants on their way to the police and to the religious and civil courts!

After all, it is explained in Bava Kamma that someone who is in pain goes to a doctor, and someone who claims he has been wronged turns to the court. The insistence on receiving judgment from the media rather than from authorized adjudication is something that calls for explanation!

I don’t know (2022-11-10)

Maybe the statute of limitations has run out, and then the police won’t open an investigation based on testimony from decades ago.

Statute of limitations? (2022-11-10)

For rape offenses, to the best of my knowledge, there is no statute of limitations, and in Torah law there is no statute of limitations at all, so the possibility of turning to a rabbinical court is never closed off. Now, with the establishment of the incoming government, it seems that the Supreme Court’s prohibition on rabbinical courts dealing with arbitration will be canceled, so there will be no obstacle at all to suing in a rabbinical court.

In his concluding letter on his position in the Chaim Walder affair, Rabbi Tau pointed to the police and/or an authorized rabbinical court that hears both sides as the proper addresses for such cases. Let the complainants and their supporters turn to the authorized investigative bodies, and a redeemer shall come to Zion. What are they afraid of?

I don’t know (2022-11-10)

There definitely is a statute of limitations even for rape offenses.
Could you describe in more detail what, in your opinion, a state rabbinical court could do in such a situation? Suppose for the sake of argument that all the judges are positively impressed by the complainant’s words and think in their hearts that she is telling the truth. What do they actually have the power to do? What can be claimed from Rabbi Tau? Can they summon him to give an affidavit? Can they impose fines on him? Can they publish a public statement?

A response to Shefatyahu Abu-Shehadeh the Digging One

Nehama Te’ena said that she filed a complaint already two months ago and was told they would not summon him for questioning without public outcry.

From her Facebook on 16.8.22:
“I underwent a polygraph test, I contacted the police, an article was filmed that was supposed to go up yesterday, and because of the pressure his people exerted it still hasn’t been published.”

A petition from a few weeks ago can be seen here – https://www.atzuma.co.il/kalebbenjefone?fbclid=IwAR00PxmxVOdqhGB_zhDF0PeOE2C8oMSRYdgUepzIkmdpvGwi59thvkcUlsY

Omer Bar-Lev, summon Rabbi Tau for questioning and confrontation with me..
I’m not even demanding that people believe me.
But it cannot be that already in August a complaint was filed against him for severe sexual abuse and threats, and he still has not been summoned for questioning.

In a post on 25.10.22 she wrote:
Good morning
I’m asking for help from those who believe me and also from those who don’t know what the truth is.
Please share the post.
Please sign the petition.
All I’m asking is that Rabbi Tau be summoned for questioning and confrontation with someone who filed a police complaint about serious things against him.
Help me!

Later she wrote: I am not demanding that someone who hasn’t heard me and seen me believe me, only that they demand an investigation.
In the post someone asked her: Can you upload a photo of the complaint you filed with the police?
And she answered: I don’t have it, but any inquiry to the police spokesperson will be answered by saying there is an open case. Feel free to contact them.

Where is the police? (Yes… it’s bizarre, and you can call the police and ask what is happening with the investigation of Nehama Te’ena—they will tell you it’s being handled, and the investigator himself told them that if there isn’t public pressure, they won’t summon Rabbi Tau for questioning.)

Nehama Te’ena is demanding a police investigation.
The police are afraid and are silencing it because this is a public figure with great power.
Only if there is strong public outcry will there no longer be legitimacy for avoiding an investigation.

Continuation of the response:
In the video here – https://www.youtube.com/watch?v=EcTUw8GzK8w
15:40
“The police are definitely involved in everything that’s happening, in everything we’ve been going through lately. By the way, yes, the police themselves told us that media publicity would help in getting him summoned for questioning right now.”
20:10
“The police want to help, absolutely, they want to help, they want to work, they just said that with media pressure we work, we summon him for questioning and continue.”
20:34
The interviewer: That’s what they told you at the police station? Apply media pressure.
She answers: Yes. Good question. A good question that all of us in the State of Israel need to ask—why is it like that?

Several questions (to Yoel) (2022-11-11)

To Yoel — greetings,

Just from the materials Ms. Te’ena herself uploaded, a number of questions arise:

If she filed a complaint with the police, how is it that she didn’t keep a copy of the complaint and the responses from the police spokesperson?
Interesting to hear that Rabbi Tau controls the police, the State Attorney’s Office, the Takana Forum, and Rabbi Shmuel Eliyahu, and silences them all.
3. She says: “It is forbidden to go to the police,” but Rabbi Tau ruled in his letter about the Walder affair that the option he recommends to every complainant is to go to the police.
She says there are 7 more complainants. Why aren’t they going to the police?
She says he harmed her both at age 8 and later as a married woman. Why did she go back to him again?

Regards, S.A.S.H.

Although I do know of one body that Rabbi Tau has taken over: namely Tel Aviv University, since all the emails of its lecturers and employees end with @tauex. tau.ac.il

And for a different version (2022-11-11)

The version of Yosef Te’ena, her former husband, can also be viewed online. Anyone interested can google it.

Yehoshua Benjo (2022-11-11)

S.A.S.H., note that I am not taking a position, because unlike you I truly don’t know. I only hope, for everyone’s sake, that the truth will be clarified whatever it may be. Even a close student of Rabbi Tau wrote this way.
One last thing: this is not about sexual harassment shading into indecent acts; these are very serious accusations from a completely different realm: pedophilia and sexual assault.
It may be that Rabbi Tau, may he live long, was and remains pure as snow, righteous and upright—as we have known him all these years. But why do you phrase yourself in a way that makes it seem as though you are a prophet, son of a prophet, who knows this in advance?

I referred to the authorized channels of investigation (to Yehoshua) (2022-11-11)

To Y.B. — greetings,

I do not need to take a position. I referred to the proper channels of investigation, raised several questions about the accuser’s claims, and referred to the different version voiced by her former husband. I am neither a prophet nor the son of a prophet, nor even a herdsman and a dresser of sycamore trees, though I did live for about three years in Nokdim 🙂

Regards, S.A.S.H.
